The publication of Amoris laetitia initiated numerous discussions in the circles of theologians who focus on the question of the possibility of sacraments for remarried divorced couples. One of the fundamental theological questions in reference to marriage is the problem of the indissolubility. The apostolic exhortation shows no chapter or any point about the indissolubility of marriage but Amoris laetitia in numerous places talks about the problem of divorce and the stable indissoluble character of marriage. Zagadnienie przysięgi małżeńskiej jest przedmiotem refleksji specjalistów z zakresu prawa kanonicznego, liturgistów i teologów. W teologii refleksja o przysiędze małżeńskiej często jest redukowana do wyjaśnienia jej treści i kwestii szafarza sakramentu małżeństwa. W dokumentach Kościoła katolickiego o małżeństwie i opracowaniach teologów jednomyślne jest stanowisko o przysiędze małżeńskiej jako konstytutywnym elemencie sakramentu. Herbert Doms belongs to the circle of German theologians that in the first half of the twentieth Century contributed to the discussions on the teaching of the purpose of marriage. His book About the meaning and the purpose of marriage published 1935 in Breslau became an important work that proposed the distinction between the meaning and purpose of marriage and on this way opened new ways in Catholic theology towards an understanding of marriage. Doms worked out his understanding of marriage on the basis of his studies, research and publications in the field of natural sciences and his theological studies especially amongst scholastic thinkers.
